PROPYLENE GLYCOL WARNING: Our cartridges contain Propylene Glycol [or Vegetable Glycerin] and Nicotine. A constituent of almost all of our products, Propylene Glycol is used in everyday use and is considered food safe by the food standards agency (FSA) in the UK.

Additionally: Vegetable Glycerin is also used in our eLiquid compositions which again, is also in everyday use and considered safe. Nicotine, however is an addictive toxin and self administration is entirely at the users own discretion and risk. Please make sure that you carry out specific research and read our FAQ section on the website. Do not ingest the liquid directly or have prolonged contact with skin. Keep out of reach of children. Exposure to the cartridges can lead to serious injury and death.  eCigsCompany are in no way responsible for the misuse and abuse of its products by you the consumer.

These terms and conditions govern the sale of products to you by  eCigsCompany (hereafter "us"). Completion of a transaction (via, web, phone or letter) with  eCigsCompany by you constitutes an agreement to these Terms and Conditions.

Please read these conditions carefully before purchasing products from us.

1. OUR CONTRACT

When you place an order to purchase a product from us, you will be sent an e-mail by The eCigs Company on our behalf confirming receipt of your order and setting out the details of your order.

2. DELIVERY

Items sold by us on the  eCigsCompany website(s) are dispatched from the United Kingdom to destinations throughout the world. The shipping cost will increase for destinations outside of the United Kingdom and eCigsCompany are in no way responsible for the detention of any goods by any countries associated customs or legal departments. If you are planning to purchase goods from  eCigsCompany, from outside the EU, please ensure you are aquainted with your relevant revenue and customs authorities or border control departments.

3. RETURNS

In accordance with the Distance Selling Regulations, the following applies to all mail order and E-Commerce contracts:

The buyer is entitled to return the goods within 7 working days for a refund subject to the following:

i) It is reasonable for the buyer to open the outer packaging and inspect the goods. It is not acceptable to break any seals on the item itself. Due to the nature of the product, our hygiene policy is STRICT and under no circumstances should our products be used prior to returning back to us. Following a visual inspection of the goods, if you are not satisfied with the quality or condition of the goods received, you are obliged under this agreement to return them to us in the same condition you received them in, including any packaging or postal material supplied.

ii) If the buyer properly rejects any of the goods in accordance with the Distance Selling Regulations within 7 working days in writing/email, the buyer shall nonetheless be responsible for the return cost of the goods.

iii) If the returned goods received by eCigsCompany are not in a sellable 'as new' condition, then eCigsCompany reserves the right to charge a restocking fee.

Whether goods are returned in a saleable condition is to be judged by  eCigsCompany.

eCigsCompany accepts no responsibility for any consequential loss caused to the buyer for the receiving of faulty goods. Faulty goods received shall be dealt with as outlined below.

Whilst every effort shall be made to keep any delivery date, time of delivery cannot be guaranteed and no such undertaking wil be given by The eCigs Company. The eCigs Company shall not be liable for any consequential loss incurred by the buyer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.

Where an agreement is in place for repeated purchasing/restocking of an agent or wholesale customer, The eCigsCompany reserves the right to deliver, in instalments any goods ordered on credit. Unless otherwise agreed eCigsCompany may deliver by installments and in such case each installment shall be treated as a separate contact and any delay, default or non-delivery in respect of any installment by the Company shall not entitle the buyer to cancel the remainder of the Contract.

eCigsCompany cannot accept any returned goods found to fall into one or more of the following categories:

i) The goods are in some way physically damaged by the buyer.

ii) The goods are found not to have been sold to the customer by  eCigsCompany.

Goods received by the buyer that are found to be physically damaged by the courier must be reported to  eCigsCompany immediately. The maximum time allowed to report physical damage is 72 hours. After 72 hours, any claims of physical damage will not be accepted for refund or replacement.

4. FAULTY ITEMS, RETURNS & WARRANTY

eCigsCompany offers a 2 month warranty on all items except atomisers and clearomisers which are one month. .All postage costs for returning items to  eCigsCompany are the responsibility of the customer.

i) Goods found to be faulty within 14 days of purchase will be replaced once we have been notified of the problem via email. Items sent back to us without prior notification will result in either a delay of processing or no processing at all.

ii) Goods found to be faulty after 14 days but before the end of the warranty period will have to be returned to us first before a replacement is sent out.

iii) Warranty on atomizers is based on 1ml usage per day, therefore, a 1 month warranty on an atomizer is based on 60ml usage in total. If this limit is exceeded and the atomizer fails, it is deemed failed due to normal usage. Atomizers have varying life spans, please bare this in mind when making a warranty claim.

Please note, atomizers used at a rating above what they were designed for will void the warranty. Vaping at a higher voltage than the atomiser was designed for, will immediately void the warranty. It is important to note that this is a common policy in the electronic smoking industry and is a consideration which the consumer must be aware of prior to returning their goods as faulty’.

Notification of a warranty return must be made by email before the items are sent back.

5. PRICING AND AVAILABILITY

We list availability information for products sold by us on the The eCigs Company platform. We cannot be more specific about availability. Please note that dispatches are not guaranteed dispatch times and should not be relied upon as such.

eCigsCompany  reserves the right to change pricing and availability at its sole discretion. The only exception to this are existing sales, where payment has been received prior to shipping.  eCigsCompany, without notice or penalty change product prices or delivery conditions. Wherever possible,  eCigsCompany will endeavour to provide products in the advertised condition. Where we are unable to achieve this, your statutory rights remain unaffected assuming you return your goods within the 7 day period, as set out in the Distance Selling Regulations.

6. OWNERSHIP AND TITLE

All ownership, title and risk of loss and/or damage in the product you have purchased shall pass to you at the point and time at which such product leaves our premises in the United Kingdom.

7. CUSTOMS

If your delivery address is outside the United Kingdom, but within the EU. Our standard shipping terms and conditions will apply as shown below. If your delivery address is outside both the United Kingdom and the EU, the addressee will be the importer of record and must comply with all laws and regulations of the country into which the products are delivered. The product may be subject to import duties and taxes, which are levied once the package reaches the country of delivery. Any such additional charges levied for customs clearance must be borne by you. Please note that we have no control over these charges and cannot predict what they may be at any time in the future.

8. PRIVACY

eCigsCompany  are committed to protecting your privacy. We will only use the information collected from you lawfully (in accordance with the Data Protection Act 1998).  eCigsCompany is registered within the United Kingdom with the Office of the Information Commissioner (OIC) and adhere to strict control where we handle your personal information.

SESSION COOKIES: Our website uses session cookies which collect information on our customers to enable a smoother browsing experience. Should you object to our use of session cookies, please be aware, we produce a downloadable PDF catalogue and offer purchases via Postal Orders and via PayPal requests. ADDITIONAL INFORMATION: We collect information about you for two reasons: firstly, to process your order and secondly, to provide you with the best possible service. The type of information we collect about you includes: your name, address, phone number and e-mail address. We will not pass on your details to any third parties.

We will not e-mail you in the future unless it is to respond to any comments or queries you may have. The personal information which we hold will be held securely in accordance with the law.

9. USE DURING PREGNANCY / ILLNESS

eCigsCompany  does not sell products for purchase by persons under 18, and strongly recommend people who are pregnant DO NOT use our product. Our products are a Nicotine delivery system and although the 4000+ chemicals found in conventional cigarettes are not present, smoking of any kind is not 100% safe and especially during pregnancy or serious illness. The lack of combustion in our products significantly reduces the risks associated with smoking during pregnancy however, the addictive nicotine element still remains in the eLiquid products which will be transferred into the blood stream during atomisation. For this reason, we strongly advise all persons who are currently pregnant or looking to become so in the near future refrain from any kind of smoking, whether electronic or conventional. Wherever possible we would advise you engage with a smoking cessation advisor for a long term solution to your habitual smoking. With regards to your unborn babies health, Nicotine is absorbed into the blood stream, so changing cigarette style will not reduce the nicotine levels found in your baby’s blood and could harm your baby..

10. ELECTRONIC COMMUNICATIONS

When you transact with us or send e-mails to us, you are communicating with us electronically. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

11. LOSSES

The eCigs Company will be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you submitted your order to us, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable to both you and us when you submitted your order to us or when a contract for the sale of goods by us to you was formed.  eCigsCompany does not accept responsibility or liability by law, in any way for death or personal injury caused from the use of our products.

12. ALTERATIONS TO SERVICE OR CONDITIONS

We reserve the right to make changes to our policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

13. FORCE MAJEURE

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your statutory rights.

14. WAIVER

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

15. GOVERNING LAW AND JURISDICTION

Your relationship with us is governed by and construed in accordance with the laws of the England, the United Kingdom of Great Britain and the law courts of the European Union (EU). Where a dispute over precedence arises, the law courts of England shall have exclusive jurisdiction over any disputes arising out of these terms and conditions. For purchases or agreements made outside of the United Kingdom and the EU, the courts of England will have exclusive jurisdiction over any disputes arising from these terms and conditions.
